This is an electronic record under the Information Technology Act, 2000 and does not require a physical signature.

These terms apply when you use a Nexero immersive property tour. They're short. By ticking the box on the onboarding screen, you agree to them.

1. Who you're agreeing with

"We", "us" and "Nexero" mean Nexero.

Nexero is currently operated by its founders as an unincorporated business. On incorporation of Nexero Private Limited, our rights and obligations under these terms will transfer to that company. We'll publish an updated version recording the change. Nothing you're agreeing to will change.

2. What Enigma is

Enigma is an interactive 3D tour of a property project, streamed to your device. It lets you explore the layout, the amenities, the surroundings and individual units or plots, before or instead of visiting in person.

Nexero builds and runs the tour. Venice of Mumbai 3.0 belongs to Tulsi Realty, not to us. We're the software.

3. Who can use it

Enigma is for people who are 18 or over and who are exploring a property as a prospective purchaser, or on behalf of one.

By using the tour you confirm you're 18 or over. If you aren't, please don't use it.

4. What a tour is not

A tour is a visualisation, not an offer to sell. This clause matters more than any other on this page, so please read it.

• Everything you see is an artist's impression. Layouts, dimensions, finishes, materials, views, landscaping, trees, skies, surrounding buildings and infrastructure are all illustrative. The property as built will differ.
• Nothing in a tour is a representation, warranty or offer about the property, by us or by Tulsi Realty.
• Prices, availability and unit status may be out of date. They come from the developer and change without notice.
• We are not the seller, the broker, or the developer's agent. Any purchase is between you and Tulsi Realty, under their documents.
• Verify independently before you commit. Check the RERA registration and the disclosures on the RERA portal, the sanctioned plans and approvals, the sale agreement, and inspect the site. Take your own professional advice.

If a tour and the developer's official documents disagree, the official documents are right.

5. What we let you do

We give you personal, non-transferable, revocable permission to use the tour to explore the project, for as long as it's made available to you.

6. What you shouldn't do

Please don't:

• Record, capture, copy, download or redistribute the tour or any part of it, except by using a share function we provide
• Reverse-engineer, decompile, scrape or extract the 3D models, textures, code or data behind it
• Use it commercially without our written permission, including reselling access or using our visuals to market a property
• Interfere with it, attempt unauthorised access, or introduce anything harmful
• Give false information during onboarding, or use someone else's name or number
• Use it in any way that breaks the law

If you do any of these we can end your access immediately.

7. Who owns what

The software, the tour experience, the interface, the 3D environment, and the behavioural data and analytics generated by it belong to Nexero or our licensors.

The project design, architectural drawings, branding and marketing materials belong to Tulsi Realty or their architects.

Nothing here gives you ownership of either. You keep whatever you already own.

8. Your information

We record your name, your number, your answers, and what you look at during the tour. We build a profile of your visit, score it, and pass both to Tulsi Realty's sales team.

All of it is in our Privacy Notice, which you should read. It's a separate tick on the onboarding screen because it's a separate thing you're agreeing to.

9. Availability

The tour is provided as is, without warranty. It depends on your internet connection, your device and third-party streaming infrastructure, and it may be unavailable, interrupted or slow. We don't promise it will work at any particular time or be free of faults, and we may change, suspend or withdraw it.

10. Liability

To the fullest extent the law allows:

• We are not liable for any purchase decision you make. See clause 4.
• We are not liable for anything Tulsi Realty does, including what they do with your contact details, how they follow up, or how the project is built or sold.
• We are not liable for indirect or consequential loss, loss of opportunity, or loss of profit.
• Our total liability to you for anything connected with the tour is limited to ₹10,000.

Nothing here excludes liability that cannot lawfully be excluded, including for fraud, or death or personal injury caused by our negligence.

Nothing here affects your rights under the Consumer Protection Act, 2019.

11. Ending it

You can stop using the tour at any time. To have your information deleted, follow the Privacy Notice.

We may suspend or end your access at any time, particularly if you break clause 6.

Clauses 4, 7, 8, 10 and 13 survive.

12. If something goes wrong

Tell us first: team@nexero.ai. We'll acknowledge within 7 days and try to resolve it within 30. Most things are quicker to fix than to argue about.

13. Governing law

These terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction.

14. General

• If any part of these terms is unenforceable, the rest stands.
• We may update these terms and will publish a new version with a new number and date. Continuing to use the tour after that means you accept the update.
• You can't transfer your rights under these terms. We may transfer ours, as clause 1 describes.
• These terms and the Privacy Notice are the whole agreement between us about the tour.
